These governing documents for your community association must be read in conjunction with certain state and federal laws. In this article, we will discuss those relevant laws that must be considered by your HOA.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-thumbnail wp-image-458\" title=\"HOA\" src=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2010\/12\/community01-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" \/><\/p>\n<p><!--more--> Obviously, your association is governed by Virginia laws and federal laws.\u00a0 In particular, you should be familiar with the following:<\/p>\n<p>First, Property Owners Associations (commonly known as Homeowners Associations) are governed by the following Virginia statutes:<\/p>\n<ul>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC13010000010000000000000\" target=\"_self\">Virginia Nonstock Corporation Act<\/a> (if the association is incorporated). <em>See<\/em> Va. Code Ann. 13.1-801 <em>et seq.<\/em><\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC55000000026000000000000\" target=\"_self\">Virginia Property Owners\u2019 Association Act<\/a>. <em>See<\/em> Va Code Ann. 55-508 <em>et seq<\/em>.<\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC55000000029000000000000\" target=\"_self\">Virginia Common Interest Community Management Information Fund<\/a>. <em>See<\/em> 55-528 <em>et seq.<\/em><\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC54010000023000030000000\" target=\"_self\">Common Interest Communities<\/a> <em>See <\/em>Va. Code Ann. 54.1-2345 <em>et seq<\/em>.<\/li>\n<\/ul>\n<p>Next, Condominium Associations (commonly known as Unit Owners Associations) are governed by these Virginia statutes:<\/p>\n<ul>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC13010000010000000000000\" target=\"_self\">Virginia Nonstock Corporation Act<\/a> (if association is incorporated). <em>See<\/em> Va. Code Ann. 13.1-801 <em>et seq.<\/em><\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC55000000004000020000000\" target=\"_self\">Virginia Condominium Act<\/a>.\u00a0 <em>See<\/em> Va. Code Ann 55-79.39 <em>et seq.<\/em><\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC55000000029000000000000\" target=\"_self\">Virginia Common Interest Community Management Information Fund<\/a>. <em>See<\/em> 55-528 <em>et seq.<\/em><\/li>\n<li><a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+TOC54010000023000030000000\" target=\"_self\">Common Interest Communities<\/a> <em>See <\/em>Va. Code Ann. 54.1-2345 <em>et seq<\/em>.<\/li>\n<\/ul>\n<p>Sometimes we may be concerned that your governing documents conflict with an applicable Virginia statute.\u00a0 In such a situation, the relevant Virginia statute will prevail over your the terms of your governing documents. Therefore, it is important that your <a href=\"http:\/\/www.tarleyrobinson.com\/starley.html\" target=\"_self\">experienced HOA attorney<\/a> reviews with you your governing documents and the relevant statutes to determine whether your documents do actually conflict with the statute.\u00a0 For example, portions of the Virginia Nonstock Corporation Act include language that prefaces the statute, such as, \u201c\u2026[u]nless the articles of incorporation or bylaws provide otherwise,\u2026.\u201d\u00a0 In those instances the provision found in your articles of incorporation or bylaws would control even if it conflicted with the balance of the statute.<\/p>\n<p>Your analysis of your governing documents does not stop with Virginia statutory law because judicial decisions impact your community.
