This blog post will review some of the issues regarding condos and bedbugs.<\/p>\n<p style=\"text-align: center;\"><a href=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2013\/02\/MC900053160.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-2327\" src=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2013\/02\/MC900053160.jpg\" alt=\"Bedbugs and Condos\" width=\"87\" height=\"99\" \/><\/a><\/p>\n<p><!--more--><strong>Who is on the Hook?<\/strong><\/p>\n<p>In general, all condominium unit owners are responsible for the interior of their units, including keeping the unit free from infestations of any type. \u00a0However, what happens when bedbugs infiltrate the walls, moving from one unit to another, traversing the common elements along the way?<\/p>\n<p>If your association receives notice that there are bedbugs in the common elements, it is time to act. \u00a0Naturally, however, the infestation will not be eradicated by simply treating the common elements. \u00a0Many associations choose to treat unit interiors and the common elements together, in the hope of wiping out the infestation once and for all. \u00a0Most condominium instruments permit the Association to treat the interior of the units and then charge the owner, however, when owners are resistant, this is not always an easy solution.<\/p>\n<p><strong>To Treat or Be Sued<\/strong><\/p>\n<p>In Evanston, Illinois, a <a href=\"http:\/\/evanston.patch.com\/articles\/condo-association-sues-resident-over-bedbug-infestation\">condominium unit owners\u2019 association sued an owner<\/a> who refused to have his bedbug infested condominium treated by exterminators. \u00a0Faced with a bedbug infestation, the condominium association paid to have all of the condominium units in one of its buildings exterminated. \u00a0One owner failed to cooperate and is now facing an injunction action. \u00a0In essence, the association is suing the owner to treat his unit.<\/p>\n<p><strong>An Ounce of Prevention<\/strong><\/p>\n<p>Reports of bedbug infestations are becoming more and more prevalent. \u00a0It is essential that condominium associations take proactive steps to get ahead of this growing problem through owner education and the implementation of policies and procedures aimed at <a href=\"http:\/\/www.pestworld.org\/all-things-bed-bugs\/bed-bug-prevention\/\">bed bug prevention<\/a>. \u00a0\u00a0As with most things \u2013 an ounce of prevention is worth a pound of cure, so contact <a href=\"http:\/\/tarleyrobinson.com\/?page_id=47\">your experienced community association lawyer<\/a> to discuss ways to protect your unit owners association.<\/p>\n<p><span style=\"color: #993300;\"><strong>Tarley Robinson, PLC, Attorneys and Counsellors at Law<\/strong><\/span><\/p>\n<p><span style=\"color: #993300;\"><strong>Williamsburg, Virginia<\/strong><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>When water leaks from one condominium into another, determining the responsible party is usually not too difficult.
