In neighborhoods governed by a homeowner or condominium association, boards of directors are sometimes asked to enforce sign restrictions when one neighbor complains about another\u2019s political sign (and probably, the neighbor\u2019s choice of candidate).<\/p>\n<p>A person\u2019s first response typically is \u201cI have the right to free speech and you can\u2019t stop me from posting my political sign on my property!\u201d However, is that the end of the discussion? This blog post reviews a community association\u2019s rights and responsibilities regarding political signs.<\/p>\n<p><a href=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2012\/09\/political-sign.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-thumbnail wp-image-2181\" title=\"political signs\" src=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2012\/09\/political-sign-150x150.jpg\" alt=\"\" width=\"150\" height=\"150\" srcset=\"https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2012\/09\/political-sign-150x150.jpg 150w, https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2012\/09\/political-sign-300x300.jpg 300w, https:\/\/blog.tarleyrobinson.com\/wp-content\/uploads\/2012\/09\/political-sign.jpg 325w\" sizes=\"(max-width: 150px) 100vw, 150px\" \/><\/a><\/p>\n<p><!--more--><\/p>\n<p><strong>Localities have a limited ability to restrict political signs placed upon private property<\/strong><\/p>\n<p>The United States Supreme Court has ruled that <a href=\"http:\/\/scholar.google.com\/scholar_case?case=3859249994867287155&amp;q=City+of+Ladue+v.+Gilleo&amp;hl=en&amp;as_sdt=4,60\">\u201csigns are a form of expression protected by the Free Speech Clause\u201d<\/a> of the United States Constitution. However, for a variety of reasons, municipalities may regulate the signs, including the physical characteristics (e.g. size) of signs. Virginia has a statute that permits localities to restrict the <a href=\"http:\/\/leg1.state.va.us\/cgi-bin\/legp504.exe?000+cod+15.2-2280\">\u201csize, height, area, bulk, [and] location\u201d<\/a> of signs. The <a href=\"http:\/\/www.oag.state.va.us\/Opinions%20and%20Legal%20Resources\/Opinions\/2012opns\/12-043%20Ramadan.pdf\">Virginia Attorney General issued an opinion<\/a> in response to a question about the validity of local ordinances that place greater size restrictions on political signs than other temporary signs. The AG wrote that<\/p>\n<p style=\"padding-left: 60px;\">It is my opinion that any zoning ordinance that places heavier burdens or greater restrictions on temporary political signs than are placed on any other classification of temporary sign is pre-empted by state law, thereby rendering any such ordinance invalid.<\/p>\n<p>Therefore, it is clear that municipalities cannot ban political signs, but can place certain limitations as to the physical characteristics of those signs.<\/p>\n<p><strong>A Community Association probably can restrict and prohibit political signs if its governing documents restrict signs<\/strong><\/p>\n<p>The <a href=\"http:\/\/en.wikipedia.org\/wiki\/First_Amendment_to_the_United_States_Constitution\">First Amendment of the United States Constitution<\/a> applies to attempts taken by a government entity to restrict speech. Those provisions do not apply to community associations, do they?<\/p>\n<p>Generally speaking, the answer is \u201cNo.\u201d Free speech protections do not generally apply to restrictions taken by private entities, like a community association. However, although Virginia courts have not addressed this specific issue, courts in other states have been somewhat divided on whether an HOA\u2019s restriction on political signs constitutes sufficient state action to violate an individual\u2019s constitutional rights.<\/p>\n<p>For instance, the <a href=\"http:\/\/scholar.google.com\/scholar_case?case=8939358456720550812&amp;q=Mazdabrook+Commons+Home-+owners%E2%80%99+Association+v.+Khan&amp;hl=en&amp;as_sdt=4,31\">New Jersey Supreme Court<\/a> relied upon its state constitution to permit political signs, finding \u201can individual&#8217;s affirmative right to speak freely \u2018is protected not only from abridgement by government, but also from unreasonably restrictive and oppressive conduct by private entities.\u2019&#8221; Taking a different approach but with a similar result, the <a href=\"http:\/\/scholar.google.com\/scholar_case?case=3590512346800413259&amp;q=Board+of+Managers+of+Old+Colony+Village+Condominium+v+Preu&amp;hl=en&amp;as_sdt=4,22\">Massachusetts Supreme Court<\/a> found that because a condominium was subject to a state statute, the association\u2019s prohibition on certain signs constituted sufficient \u201cstate action\u201d to violate the First Amendment of the United States Constitution.<\/p>\n<p>On the other side of the argument, the <a href=\"http:\/\/scholar.google.com\/scholar_case?case=2903923335053669748&amp;q=Linn+Valley+Lakes+POA+v.+Brockway&amp;hl=en&amp;as_sdt=4,17\">Kansas Supreme Court<\/a> held \u201cThere is nothing constitutionally impermissible per se in a private agreement restricting signs in a residential neighborhood, and enforcement thereof does not constitute improper state action.\u201d Similarly, the <a href=\"http:\/\/livepage.apple.com\/\">Pennsylvania Superior Court<\/a> held that because a condominium association was a private organization, the association\u2019s enforcement of its declaration\u2019s sign provisions was \u201cnot an impermissible infringement of free speech in violation of the United States Constitution.\u201d<\/p>\n<p>Since this article was originally published, Virginia amended the Property Owners&#8217; Association Act to require <a href=\"https:\/\/law.lis.virginia.gov\/vacode\/title55.1\/chapter23.1\/section55.1-2310\/\">disclosure of political sign restrictions in association disclosure packets<\/a>. However, Virginia has not adopted legislation broadly prohibiting HOAs from regulating or restricting political signs. Accordingly, the general rule remains that properly adopted and enforceable HOA covenants may regulate political signs, subject to applicable statutory requirements and principles of reasonableness.<\/p>\n<p><strong>Bottom Line<\/strong>: In Virginia, an HOA may generally regulate or prohibit political signs if the restriction appears in the governing documents or properly adopted rules. The First Amendment does not automatically invalidate those restrictions because an HOA is generally a private association rather than a governmental entity. However, before implementing any restriction on political signs, or assessing charges against a homeowner who displays such a sign, associations would be well-advised to contact their <a href=\"http:\/\/tarleyrobinson.com\/?page_id=47\">experienced HOA attorney<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Well, it\u2019s that time of year when signs start popping up in neighborhoods as election day draws near.
